ABOUT THE PROCESS
PreliminaryNotice.com is a free site intended to serve two purposes.

First, it benefits subcontractors and suppliers giving more "notice" to lenders, developers and contractors through publication on our searchable, on line website. This additional exposure will notify more people that work has been done on a project and monies are owed. Typically, the more people know you are working on a project, the more likely you will get paid.

Second, it benefits the lenders, developers and contractors by assisting them to discover exactly who is owed money on their project - and thus avoids mechanic's liens or double payment of services.

HOW IT WORKS
Simply put, once a subcontractor or supplier issues a preliminary notice, this notice is uploaded to our searchable database, thus giving more "notice" to outsiders. For a detailed instruction as to how to get started please go to our INSTRUCTION page


ABOUT THE COMPANY
Preliminary Notice, LLC is funded privately. It is a california limited liability company. It's mission is to transform the preliminary notice process through technology. It's goal is to eliminate the archaic mailing of notices.

WHAT IS A PRELIMINARY NOTICE
Preliminary notices are also known as Pre-lien notices and 20-day notices, and relate to the construction and real estate development industry. The need for preliminary notices stem from the constitutional requirement to give "notice" before property rights are taken. When a subcontractor, whose work improves real estate, or a vendor whose materials are used to improve real estate, do not get paid for such services or materials, they are afforded the right to file a lien (known as a mechanic's lien) against that improved property to force payment from the owner. A mechanic's lien is a powerful tool because it can force the owner to sell the property to pay the lien. Becuse this is considered a "taking of property", in most states, before a mechanic's lien is filed, notice (ie "preliminary notice") must be given to the owner and others.
